Please read these Terms of Service ("Terms") carefully before using LendLocal (the "App"), developed by CB Studio ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of the App
LendLocal is an automated lending tool that interfaces with the Bitfinex cryptocurrency exchange on your behalf. The App runs entirely on your device and uses your own Bitfinex API credentials to manage funding offers in the peer-to-peer lending market. The App does not provide brokerage, investment advisory, or financial services.
Not Financial Advice. LendLocal is a software tool only. Nothing in the App or these Terms constitutes financial advice, investment advice, or a recommendation to buy, sell, or hold any asset. All lending decisions are ultimately yours.
2. Eligibility
By using the App, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction)
- You have a valid Bitfinex account and comply with Bitfinex's own terms of service
- Your use of the App is lawful under the laws of your jurisdiction
- You have the legal right and authority to engage in cryptocurrency lending activities in your country or region
3. User Responsibilities
3.1 API Key Security
You are solely responsible for the security of your Bitfinex API keys. You should:
- Create API keys with only the minimum permissions necessary for lending (read access + funding order management; no withdrawal permissions)
- Never share your API keys with anyone
- Immediately revoke and replace keys if you suspect compromise
- Protect your device with a passcode, Face ID, or fingerprint lock
3.2 Lending Decisions
You acknowledge that:
- You are solely responsible for configuring the App's lending parameters (interest rates, durations, minimum amounts, etc.)
- The App will execute lending actions automatically based on your configuration
- Past lending rates and returns do not guarantee future results
- You bear all financial risk associated with lending on the Bitfinex platform
3.3 Compliance with Bitfinex Terms
Your use of LendLocal must comply with Bitfinex's own Terms of Service, acceptable use policies, and API usage guidelines. We are not affiliated with Bitfinex and cannot be held responsible for any actions Bitfinex takes with respect to your account.
4. No Guarantee of Results
We make no representations, warranties, or guarantees that:
- The App will generate any profit or specific return
- The App will execute offers at any particular rate or timing
- The App will be available or function without interruption
- Any lending strategy implemented by the App is optimal or suitable for your circumstances
Risk Acknowledgment. Cryptocurrency lending involves significant financial risk, including but not limited to: counterparty default, exchange insolvency, regulatory changes, market volatility, and technical failures. You accept all such risks by using the App.
5. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by applicable law, CB Studio expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties of title and non-infringement
- Warranties that the App will be error-free, secure, or uninterrupted
- Warranties as to the accuracy or reliability of any results obtained through the App
6. Limitation of Liability
To the maximum extent permitted by applicable law, CB Studio and its developers shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages
- Any financial losses, including lost profits or lost lending income
- Losses arising from unauthorized access to your API keys or Bitfinex account
- Losses due to exchange downtime, API changes, or Bitfinex platform issues
- Any bugs, errors, or inaccuracies in the App's lending logic
- Losses arising from your misconfiguration of the App's settings
In no event shall our total liability exceed the amount you paid for the App (if any).
7. Intellectual Property
The App and its original content, features, and functionality are owned by CB Studio and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use on your own devices.
You may not:
- Copy, modify, or distribute the App's source code
- Reverse engineer or decompile the App
- Sublicense, sell, or rent the App to third parties
8. Termination
You may stop using the App at any time by uninstalling it. We reserve the right to discontinue the App or release updates that change its functionality at any time without notice. We are not obligated to provide maintenance, updates, or support.
9. Third-Party Services
The App connects to the Bitfinex API. Your use of Bitfinex is governed solely by Bitfinex's own terms and policies. We are not responsible for Bitfinex's availability, accuracy, or actions. Links to third-party websites or services are provided for convenience only and do not constitute our endorsement.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Taiwan.
11. Changes to These Terms
We may update these Terms from time to time. We will indicate changes by updating the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the App.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
